*Terms and conditions may apply. FunAccess Pass is owned and operated by FunAsia Entertainment, LLC (“FunAsia” or “us”). Upon payment of your Membership dues, specified in this pamphlet, you hereby agree to be a member of FunAccess Pass for no less than one (1) year from the date of first payment, unless you opt to cancel the membership according to the terms and conditions specified herein, at the exclusive rate of $180.00 per year for the annual membership, or $17.99 per month for the monthly membership (“Dues” or “Rate”). FunAsia may increase the Dues amount after your one-year anniversary date with or without any notice.

You authorize us to store and use your billing information connected to your membership for any recurring dues. Your dues will be automatically billed and collected electronically once every month / year (your “Billing Period”) beginning on _____________ and continuing on that same day every Billing Period or as soon thereafter as practical, until cancelled in the manner provided below. Your membership will continue and automatically renew unless you exercise your right to cancel the renewal no less than and no earlier than thirty (30) days prior to the expiration of your one-year term. You may also cancel your membership within thirty (30) days from the date of first payment or from the date you first sign up for your Membership, whichever is earlier, so long as you have not used any services or benefits under the Membership. You may cancel your membership by _______________________ within the specified period mentioned hereinabove. Until the term of your Membership expires, you will have continued the FunAccess Pass Membership. If you decide to change your billing information, a thirty (30) day notice may be required.

You further agree to the following services available to you under this Membership:

(1) Tickets to all FunAsia events. *One Event ticket per Member at no additional cost. Tickets are limited to events brought and organized by FunAsia only. Any events sponsored by FunAsia or ones with whom FunAsia has media partnerships are strictly excluded unless mentioned otherwise. Each member shall be entitled to one ticket per event, which shall be limited to a ticket of lowest value for that event. You may upgrade the ticket(s) by paying the difference between the desired upgraded ticket price and the lowest value. Any additional tickets may be purchased at a 10% discounted rate.

(2) Four Movie tickets per Month. *One Movie ticket per month at no additional cost. Only available at Fun Movie Grill locations and subject to first come first serve per movie. There are no restrictions on which movies you may watch by utilizing your four movie tickets per month, however, it is subject to availability. If you do not use all four movie tickets per month, the unused tickets will not carry over to the following month.

(3) Four (4) coupon vouchers. *Four coupon vouchers per member per month at no additional cost. Each coupon may be equivalent to $5.00. Coupon vouchers may be used at Fun Pizza Kitchen or at Fun Movie Grill concessions only, unless otherwise specified. These coupon vouchers may not be used for movie tickets. Limit one coupon voucher per visit. No purchase is necessary. The coupon may only be used once. Any unused amount will not be refunded. The coupon is not a gift card; therefore, if you do not use the full amount issued per coupon, you will waive the right to use any unused amounts. The coupons will only be valid for the month it is issued and will not be honored for any other months or after its expiration. Coupons cannot be combined with any other promotional offer or any other coupons.

(4) BigFan App Premium Access. Premium access to BigFan App is a paid subscription, which will be available to FunAccess Members at no additional cost.

(5) 10% discount on services provided by certain affiliated companies: Perfect Tax, Fun Pizza Kitchen, FunAsia Radio (104.1 HD 1), The Green Data Centre, Perfect Technology Group.

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY. You hereby acknowledge and agree that your use of this Membership and your use of any one or more of the benefits associated with the Membership may involve risks of physical or monetary damage to persons and property. You understand, voluntarily accept and assume full responsibility for such risks, which include, but are limited to, damages arising from use of one or more of the benefits associate with the Membership as well as your use of the Membership. You agree that FunAsia will not be liable for any damages to your persons or property caused by your use of the benefits under this Membership as well as your use of this Membership, and you hereby release and hold harmless FunAsia from all liability to you or anyone related to you, your personal representatives, assigns, heirs, and next of kin for any loss or damage, and forever give up any claim or demands therefore, on account of damage to person or property, including but not limited to damages caused by the active or passive negligence of FunAsia or otherwise. You hereby agree to indemnify FunAsia from any loss, liability, damage or cost FunAsia may incur due to your presence, as a result of your use of the Membership benefits, at any events or locations, or your use of any services mentioned above as part of your benefits. You further expressly agree that this release and waiver of liability and indemnity is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and that if any portion is held invalid, the balance shall continue in full force and effect. You have read this release and waiver of liability and indemnity and agree that no oral representations, statements or inducement apart from this Agreement have been made.

Agreement to Arbitrate.You and FunAsia Entertainment LLC agree that any dispute, claim or controversy arising out of relating in any way to these Terms and Conditions of FunAccess Pass, shall be determined by binding arbitration. The arbitration shall be governed by and construed in accordance with the the laws of the State of Texas, U.S.A. without regard to conflict of laws provisions and resolved by binding arbitration in Collin County in State of Texas administered by the American Arbitration Association under its Commercial Arbitration Rules.

Upon payment for FunAccess Pass, you agree to these terms and conditions as well as terms and conditions available on the FunAccess Pass website. The services are only available to Members, who have not defaulted on any payments. The services are subject to change and at FunAsia Entertainment, LLC’s discretion.
